By accessing or using Mailhook, you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Description of Service

Mailhook provides programmable temporary email inbox services, including:

API access for creating and managing email addresses
Email receiving and processing capabilities
Webhook notifications for incoming emails
Polling API for retrieving emails

3. Acceptable Use

You agree not to use our service to:

Send spam or unsolicited communications
Engage in illegal activities
Violate any third-party rights
Attempt to gain unauthorized access to our systems
Use the service for phishing or fraud

4. Account Responsibilities

You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Notifying us of any unauthorized use

5. Service Limitations

Our service is subject to usage limits based on your plan. We reserve the right to:

Throttle or suspend accounts that exceed limits
Modify features and functionality
Update pricing with reasonable notice

6. Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth herein or as required by law.

Billing: You authorize us to charge your payment method on a recurring basis according to your selected plan.
Price Changes: We may change our prices with 30 days' advance notice. Continued use after the price change constitutes acceptance.
Refunds: Annual plans are eligible for a full refund within 14 days of initial purchase. Monthly plans are not eligible for prorated refunds.
Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period.
Late Payment: Accounts with overdue payments may be suspended until payment is received.

7. Email Content and Data Ownership

You retain all rights to the email content processed through our service. By using Mailhook, you grant us a limited license to process, store, and transmit your email content solely for the purpose of providing the service.

We do not claim ownership of any content you process through our service.
You are responsible for ensuring you have the right to process any email content through our service.
Email content is retained according to your subscription plan's retention period, after which it is permanently deleted.
You may request deletion of your email content at any time through your account settings or by contacting support.

8. API Usage

Your use of our API is subject to the following terms:

Rate Limits: API requests are subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary throttling or suspension.
API Keys: You are responsible for keeping your API keys secure. Do not share your API keys or expose them in client-side code.
Programmatic Access: API access is provided for legitimate programmatic use. Automated scraping or abuse of our API is prohibited.
API Changes: We may update or modify our API with reasonable notice. We will make efforts to maintain backward compatibility where feasible.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

The service will meet your specific requirements
The service will be uninterrupted, timely, secure, or error-free
The results obtained from the service will be accurate or reliable
Any errors in the service will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRISM GATEWAY SERVICES LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of or inability to access or use the service
Any conduct or content of any third party on the service
Any content obtained from the service
Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Prism Gateway Services LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your access to or use of the service
Your violation of these Terms
Your violation of any third-party right, including any intellectual property or privacy right
Any claim that your content caused damage to a third party

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by:

Posting the updated terms on this page
Updating the "Last updated" date
Sending an email notification to account holders for significant changes

Continued use of the service after changes take effect constitutes acceptance of the modified terms. If you do not agree to the modified terms, you must stop using the service.

13. Intellectual Property

The Mailhook service, including its original content, features, and functionality, is owned by Prism Gateway Services LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, service marks, logos, and trade names may not be used without prior written consent.
You may not copy, modify, distribute, sell, or lease any part of our service or software.
You may not reverse engineer or attempt to extract the source code of our software.

14. Termination

Either party may terminate this agreement at any time:

By You: You may cancel your account at any time through your account settings or by contacting support.
By Us: We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

Upon termination:

Your right to use the service will cease immediately
Your data will be retained according to our data retention policies
You may request export of your data before termination
Provisions that by their nature should survive termination will remain in effect

15. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms due to circumstances beyond their reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved as follows:

Informal Resolution: Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.
Jurisdiction: Any legal action shall be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

19. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Prism Gateway Services LLC regarding the use of the Mailhook service, superseding any prior agreements, communications, or understandings.
